Spain's Digital Nomad Visa and Non Lucrative Visa both put you in the country legally for a year or more, but they have opposite rules on income, opposite tax implications, and opposite use cases. Pick the wrong one and you either cannot legally work or you pay full Spanish resident tax rates when you did not have to.

The Non Lucrative Visa is for people who can live in Spain without working at all, retirees, dividend recipients, passive income earners, or anyone with enough savings to self-fund. You must prove passive income or assets sufficient to cover living costs, currently about 2,400 EUR per month for a single applicant, and you are explicitly prohibited from earning any income from Spanish or foreign employment or freelance work while on this visa. The critical tax trap: NLV holders become Spanish tax residents after 183 days and are taxed on worldwide income at progressive rates up to 47%, with no access to the Beckham Law flat rate. Government and consulate fees are modest, around 80 to 120 EUR, but you will typically spend 1,000 to 2,500 EUR on a lawyer to prepare the financial documentation and apostilles required by the Spanish consulate in your home country.

Can I switch from the Non Lucrative Visa to the Digital Nomad Visa while in Spain?

Yes, you can apply to change visa category from inside Spain without leaving, but you must meet the DNV income and foreign-client requirements at the time of the switch. The Beckham Law election must be filed within six months of establishing tax residency, so if you delay switching you may miss the window for the flat tax rate.

Which visa leads to permanent residency faster?

Both lead to permanent residency after five continuous years of legal residence in Spain. The Digital Nomad Visa also counts toward the five-year naturalisation requirement for Spanish citizenship, as does the NLV, but Spain requires ten years of residence for most nationalities to naturalise.
